ARTICLE 1 — GENERAL PROVISIONS

These General Terms and Conditions of Sale ("GTC") apply exclusively to the online sale of products offered by SMART TECH ECOM LLC ("the Operator") on the website getbionny.com. The GTC are made available to customers on the Site. By checking the box or clicking the validation button, the Customer acknowledges having read and accepted them before placing an order. Validation of the order implies full and complete acceptance of the GTC in effect on the date of the order.

ARTICLE 2 — PRODUCT DESCRIPTION

The Site is an online store for beauty and wellness products ("Product(s)"). Each product is accompanied by a description mentioning its essential characteristics. Photographs are not contractual. Products comply with applicable laws in the jurisdictions where they are sold, including the European Economic Area (EEA), the United Kingdom, and the United States.

ARTICLE 3 — CUSTOMER ACCOUNT

To place an order, the Customer may be required to create a personal account. The Customer is responsible for maintaining the confidentiality of their login credentials. SMART TECH ECOM LLC reserves the right to suspend any account in case of fraudulent use or failure to comply with these conditions.

ARTICLE 4 — ORDERS AND AVAILABILITY

Orders are subject to stock availability. If a Product becomes unavailable after order confirmation, the Operator will inform the Customer by email. The Customer may then choose:

• Delivery of an equivalent product.
• Full refund within thirty (30) days.

The Operator reserves the right to refuse any order for legitimate reasons (for example, existing dispute, payment incident, or suspicious activity).

ARTICLE 5 — PAYMENT AND SECURITY

The Customer expressly acknowledges that any order placed on the Site implies a payment obligation.

• Payment Methods: Payments are processed via secure solutions. We accept major credit cards (Visa, Mastercard, Amex).
• Security: Bank details are encrypted via SSL (Secure Socket Layer) and are never stored on the Operator's servers.
• Taxes: SMART TECH ECOM LLC is currently not registered for VAT (VAT exemption). Prices are displayed as net totals.

ARTICLE 6 — INTERNATIONAL SALES AND CUSTOMS

For any order delivered outside the United States (in particular to the European Union, the United Kingdom, and other international destinations):

• The Customer is the official importer.
• Customs duties, local taxes, VAT, or import duties may apply. These fees are not included in the price paid to the Operator and are the sole responsibility of the Customer.
• The Operator is not responsible for delays caused by customs clearance.

ARTICLE 7 — DELIVERY

• Zones: We deliver to the United States of America, the United Kingdom, the United Arab Emirates, Qatar, Saudi Arabia, France, Belgium, Switzerland, Germany, the Netherlands, Sweden, Italy, Poland, Austria, Denmark, Spain, and Portugal.
• Timeframes: Products are shipped according to the timeframes indicated on the website (estimated 4 to 6 business days).
• Transfer of Risk: The risk of loss or damage is transferred to the Customer upon physical possession of the Product.

ARTICLE 8 — RIGHT OF WITHDRAWAL (RETURNS)

In accordance with applicable EU and UK consumer protection laws, Customers residing in these jurisdictions have 14 days from receipt to exercise their right of withdrawal. Customers from other jurisdictions are subject to the Operator's standard return policy.

• Exceptions: The right of withdrawal does not apply to goods unsealed after delivery and that cannot be returned for reasons of hygiene or health protection (for example, opened cosmetics).
• Procedure: Returns must be sent in their original packaging and in perfect condition. Return shipping costs are the responsibility of the Customer.

ARTICLE 9 — LEGAL WARRANTIES

Regardless of any commercial warranty, the Operator remains liable under applicable consumer protection laws, including:

• Legal Warranty of Conformity: 2 years for EU residents, in accordance with EU Directive 2019/771.
• Warranty Against Hidden Defects: In accordance with applicable consumer protection laws of the EU, the United Kingdom, and the United States.

ARTICLE 10 — INTELLECTUAL PROPERTY

All elements of the Site (texts, logos, images, software) are the exclusive property of SMART TECH ECOM LLC. Any reproduction or use without prior written authorization is strictly prohibited.

ARTICLE 11 — APPLICABLE LAW AND DISPUTES

These GTC are governed by the laws of the State of Wyoming, United States, without prejudice to the mandatory consumer protection laws applicable in the Customer's country of residence.

• Amicable Settlement: In case of dispute, first contact contact@getbionny.com.
• Mediation (EU Customers): EU customers can access the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.
• Competent Jurisdiction: Failing an amicable solution, the competent courts of the State of Wyoming, United States, shall have jurisdiction, without prejudice to the mandatory consumer protection laws of the Customer's country of residence.
