Your Consumer Guarantees (Australia & New Zealand)

The 3-Year BIONNY Warranty is an optional commercial warranty offered in addition to the mandatory consumer guarantees applicable under Australian and New Zealand law. These protections are independent and complementary, and this Warranty does not replace, restrict or affect your statutory rights.

Mandatory Australian Consumer Law notice: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For Australian customers, all products sold by BIONNY are subject to the Consumer Guarantees set out in the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), including:

  • Guarantee of acceptable quality
  • Guarantee of fitness for any disclosed purpose
  • Guarantee of correspondence with description
  • Guarantee of supply by title
  • Guarantee as to repairs and spare parts availability

The consumer guarantees apply for a reasonable period of time given the nature of the product, its price, any representations made, and normal conditions of use. There is no fixed maximum duration — they may apply well beyond any contractual warranty.

For New Zealand customers, all products sold by BIONNY are subject to the guarantees set out in the Consumer Guarantees Act 1993, including guarantees of acceptable quality, fitness for purpose, compliance with description, and reasonable durability. These guarantees cannot be contracted out of when goods are supplied for personal use.

These statutory consumer guarantees do not cover damage resulting from misuse, lack of maintenance or normal wear and tear of the product.

Article 1

General Provisions

These Terms and Conditions govern the 3-Year BIONNY Warranty (hereinafter "the Warranty"), an extended warranty programme offered by BIONNY to customers who have purchased an eligible product from an authorised BIONNY retailer or directly from BIONNY.

By subscribing to the Warranty, the customer (hereinafter "the Holder") acknowledges having read and accepted these terms in full. These terms apply in addition to any statutory rights the Holder may have under applicable consumer protection legislation, which are not affected by this Warranty.

BIONNY reserves the right to update these Terms at any time. The version applicable to the Holder is the one in force at the date of subscription, as confirmed in the Warranty Certificate.

Article 2

Eligibility & Subscription

The 3-Year BIONNY Warranty is available to any natural person or legal entity that has purchased an eligible BIONNY product. Eligibility conditions are as follows:

Eligible purchasers

  • Any customer purchasing through an authorised channel

Subscription deadline

  • Must be subscribed at the time of purchase or within 30 days

Proof of purchase

  • A valid order number and purchase receipt are required

Geographic scope

  • Valid in countries where BIONNY operates

Products covered

  • Only the specific product referenced in the Certificate

The Warranty is non-renewable. Each subscription covers a single, uniquely identified product.

Article 3

Scope of Coverage

The Warranty provides coverage for a continuous period of 36 months from the activation date on the Certificate. BIONNY's philosophy is simple: any issue arising from the use of the product is covered, without exception.

Everything is covered as long as the issue results from use of the product

  • Manufacturing defects in materials or workmanship
  • Functional failures and component breakdowns
  • Physical damage occurring during use (impacts, drops, liquid exposure)
  • Premature wear or abnormal deterioration of the product
  • Cosmetic damage affecting the proper functioning of the product
  • Any other issue identified in the context of normal or intensive use

Our commitment: At BIONNY, we fully stand behind the durability of our products. If your product develops any issue related to its use, we will find a solution — no questions asked.

Article 4

Exclusions

Under this broad coverage policy, the only situations not covered are the following:

  • The product has been intentionally damaged or fraudulently altered
  • The claim is submitted after the Warranty expiry date
  • The Holder is unable to provide a valid proof of purchase and a Certificate

Important: The Warranty is valid for one claim only. Once a solution has been provided (replacement, repair or partial refund), the Warranty is considered consumed and cannot be activated again. If in doubt, our team remains at your disposal.

Article 5

Warranty Activation

The Warranty is activated automatically upon subscription confirmation. The start date and end date are indicated on the Warranty Certificate issued to the Holder. No further action is required to activate the Warranty unless otherwise specified.

The Warranty Certificate constitutes proof of coverage and must be retained alongside the original order confirmation. BIONNY may request both documents when processing a claim.

Important: The Warranty cannot be extended or reinstated once expired. We strongly recommend keeping your Certificate in a safe location.

Article 6

Claim Process

1. Prepare your documents

Have your Warranty Certificate, order number, and original proof of purchase ready before contacting us.

2. Contact BIONNY Customer Service

Write to us by email or via the contact form on our website. Clearly describe the issue and include your Certificate reference.

3. Submit supporting evidence

Provide clear photos or videos of the defect if requested. This helps our team assess your claim accurately and quickly.

4. Receive our decision

Our team will review your claim and respond within 48 business hours with the outcome and next steps.

Article 7

Available Remedies

Upon acceptance of a valid claim, BIONNY will determine the most appropriate remedy at its discretion, from the following options:

Product replacement

  • A new or equivalent replacement product will be shipped to the Holder

Repair

  • The defective product may be repaired and returned to the Holder

Partial refund

  • In specific cases, a partial refund may be offered at BIONNY's discretion

BIONNY does not guarantee the availability of an identical replacement product. If the original model is discontinued, an equivalent product of equal or greater value may be offered.

Article 8

Transferability

The 3-Year BIONNY Warranty is non-transferable. It is attached to the original Holder who subscribed at the time of purchase. In the event of a resale or transfer of the covered product to a third party, the Warranty will no longer be valid and cannot be transferred to the new owner.

Article 9

Limitation of Liability

The Warranty is provided in addition to the Holder's statutory consumer guarantees under the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993 and does not limit, exclude, or supersede any mandatory consumer protection rights which cannot be contracted out of.

To the fullest extent permitted by applicable law, BIONNY's liability under this Warranty is strictly limited to the remedies described in Article 7. BIONNY shall not be liable for any indirect, incidental, special or consequential damages arising from the defect or from the use of the covered product, except where such exclusion is prohibited by law.

The maximum liability of BIONNY under this Warranty shall not exceed the original purchase price of the covered product. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the Australian Consumer Law or the New Zealand Consumer Guarantees Act.

These Terms and Conditions are governed by the laws of Australia or New Zealand, as applicable to the consumer's place of residence. Any dispute arising in connection with this Warranty shall be subject to the exclusive jurisdiction of the competent courts of that country.
